1Informational purposes only
Content published by Plutura is provided for general informational and educational purposes only. It is not intended to constitute financial, investment, legal, tax, medical or other professional advice.
You should not rely on Plutura content as a substitute for advice from a qualified professional who can consider your individual circumstances. Decisions involving money, investments, taxes, legal rights, health or safety may depend on facts, laws, regulations, jurisdiction and personal circumstances that Plutura cannot evaluate for individual readers.
Plutura does not guarantee any particular financial, legal, medical or other outcome from using information published on the site.
These limits also apply to our newsletters and other emails, digital resources, comments and Plutura AI. Plutura publishes general, impersonal content that is not tailored to any reader. Neither Plutura nor its authors act as your investment adviser, broker, financial planner, tax preparer, lawyer, doctor, therapist, counselor or pastor, and using Plutura does not create a fiduciary, advisory, attorney-client, healthcare, counseling or other professional relationship with you.
Articles about faith, relationships, family, mental well-being and personal growth share perspectives and general information; they are not pastoral counseling, psychotherapy, diagnosis or treatment. You are responsible for your own decisions. Before acting on something you read on Plutura, consider advice from a qualified professional who knows your situation, and never delay seeking help because of something you read here.
The same applies to every author, editor, reviewer (including expert reviewers), guest writer and other contributor, whether an employee, freelancer or outside contributor. Articles, The Plutura Letter, digital resources and comments reflect the views of the people who wrote them as of the date they were published and may become outdated. Do not rely on them as the basis for personal decisions, and understand that no author or other contributor has a professional, advisory, fiduciary, attorney-client, therapeutic or pastoral relationship with you.
2Accuracy and sources
We aim to publish accurate and useful information and may rely on government agencies, academic research, regulators, primary documents, established publications and other credible sources. Information can change over time, and Plutura does not guarantee that every article remains current indefinitely.
3Eligibility
You must be at least 13 years old to create an account or use Plutura AI, and at least 18, or have the permission of a parent or guardian, to buy Plutura Plus. Plutura is published in English for readers in the United States; if you use it from elsewhere, you are responsible for following local laws.
If you are under 18, please review these terms with a parent or guardian. A parent or guardian who buys Plutura Plus for a minor accepts these terms for that purchase and is responsible for the payment method used. You may not use Plutura in violation of United States sanctions or export-control laws, and you may not buy Plutura Plus if you are subject to United States sanctions or appear on a United States government list of restricted parties.
4Your account
Keep your sign-in details secure and your information accurate. Each account is for one person and may not be shared or transferred. You are responsible for activity on your account; if you think someone else has used it, change your password and tell us at [email protected].
5Acceptable use
When you use Plutura, you agree to the following:
- No attempts to circumvent Plutura AI usage limits or access controls
- No unlawful, abusive or misleading conduct, including in comments
- No automated access or extraction except as described in “Automated access and data extraction”
- No attempts to make Plutura AI ignore or reveal its instructions or security controls, or answer outside its purpose, and no automated or bulk querying of Plutura AI
- No harassment, threats, hate speech, defamation, spam or unauthorized advertising, and no posting of another person’s private information
- No attempts to probe, scan, test or break Plutura’s security, and no malware
- No invalid clicks, impressions or other artificial traffic on ads or other commercial placements, whether by automated tools or by repeated manual clicking
6Plutura AI
Plutura AI is an informational reading feature that explains, summarizes and points to articles Plutura has published. Its answers can be incomplete or wrong; when an answer refers to an article, the published article is the authoritative version.
Plutura AI does not provide financial, investment, legal, tax, medical or other professional advice. Usage limits apply.
Plutura AI is an automated system powered by a Claude model from Anthropic. It is not a person, and it is not a companion, counselor or substitute for professional help. Its answers are generated automatically and may be inaccurate, incomplete or out of date, and may cite or summarize articles incorrectly.
Check the linked articles and other reliable sources before you rely on an answer, especially for decisions about money, health, legal matters, relationships or safety. You are responsible for the decisions you make. To the extent permitted by law, Plutura is not liable for loss or harm resulting from reliance on answers from Plutura AI.
Plutura AI is not an emergency or crisis service. In the United States, call 911 in an emergency, or call or text 988 to reach the 988 Suicide & Crisis Lifeline. Elsewhere, contact your local emergency services.
Do not use Plutura AI to seek personalized professional advice, to share another person’s private information or to request unlawful or harmful content. Its answers are not promises by Plutura and do not change these terms, prices or the benefits of Plutura Plus.
Answers from Plutura AI are not statements or advice from Plutura’s authors or other contributors, even when they summarize or cite their articles; the protections in “Authors and contributors” also apply to those answers.
7Comments and other submissions
You keep ownership of the comments and other content you submit to Plutura. You give Plutura a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display and distribute that content on Plutura and in connection with operating it, and to let our service providers do so on our behalf. The license lasts while the content is on Plutura and afterward only as long as needed for backups, legal obligations or disputes. You confirm that you have the rights needed to submit the content and grant this license, and that it does not violate these terms or anyone’s rights.
Comments are public. Do not post anything unlawful, defamatory, infringing, deceptive or abusive, threats, harassment, spam, unauthorized advertising or another person’s private information. Comments reflect the views of the people who write them, not Plutura. They are not professional advice, and Plutura does not endorse them or check every statement in them.
We may review, hold, reject, restrict or remove any comment, and limit, suspend or end anyone’s ability to comment, at our discretion and without notice, including when we believe a comment breaks these terms or puts readers or Plutura at risk. Comments with links are reviewed before they appear. You can report a comment using the report option. To the extent permitted by law, including 47 U.S.C. § 230, Plutura is not responsible for comments posted by readers.
Nothing in these terms prevents you from writing an honest review of Plutura or transfers ownership of your review to us.
8Plutura Plus and automatic renewal
Plutura Plus is a monthly membership that renews automatically. Your first month costs US$4.99. After that, it renews automatically every month at US$9.99 until you cancel. Any applicable taxes are calculated by Polar and shown at checkout. By buying Plutura Plus, you authorize Polar to charge your payment method for each monthly period until you cancel.
Polar is the merchant of record and authorized reseller for Plutura Plus: it sells the membership to you, charges your payment method, issues receipts and invoices and handles sales tax. Polar’s checkout and buyer terms also apply to your purchase. Plutura provides the membership benefits and never receives or stores your full card details.
You can cancel at any time in My Plutura, online. To avoid the next charge, cancel before your next renewal date. Canceling stops future renewals and takes effect at the end of your current paid period; your benefits stay available until then. Canceling does not refund or credit the current period, except where the law requires it or as described in this section.
Plutura Plus includes up to 50 Plutura AI messages a day, Plutura AI conversation history, collections, the Plutura Plus Brief and a monthly digital resource, as described on the Plutura Plus page. Each resource can be downloaded on plutura.com while your membership is active and during the download period shown for that resource, which may last longer than one month. We may change, add or replace benefits. If we remove a main benefit, we will tell you in advance and you can cancel before your next renewal.
Refunds are processed through Polar under Polar’s buyer terms and the law. For billing questions, contact [email protected] or the support contact on your Polar receipt. If a payment fails, we may suspend Plutura Plus benefits until it is paid. If we stop offering Plutura Plus, or cannot provide its main benefits for a period you already paid for, we will arrange continued access or a prorated refund through Polar. Nothing in these terms limits refund or chargeback rights you have under the law.
We may change the price of Plutura Plus. We will tell you before a new price applies to you, with the notice and any consent the law requires, and you can cancel before it takes effect.
9Digital resources
Plutura Plus digital resources, such as planners and guides in PDF format, can be downloaded only on plutura.com while you are signed in with an active membership. We never send them by email. Once you download a resource, your copy is yours to keep for personal, non-commercial use: you may save it and print it for yourself, including after your membership ends. Plutura and its licensors keep the copyright and all other rights in every resource.
You may not sell, share, send, publicly post, upload or otherwise distribute a resource or its contents, use it commercially or remove its copyright notices, except as the law allows or with our written permission. After your membership ends, or after a resource’s download period ends, you can no longer download it from Plutura, and we are not required to provide it again.
10Content rights and permitted use
Articles, illustrations, photographs, the Plutura name and logo, and other material owned by Plutura are protected by copyright, trademark and other laws. You may read Plutura, share links to it, and make personal, non-commercial use of what you read.
Except where allowed by applicable law (for example, fair use, which may permit brief quotation with attribution), you may not copy, republish, scrape, redistribute, reproduce or commercially reuse Plutura-owned content, or use it to create a competing publication, database or service, without our written permission.
Some material on Plutura, such as third-party images, quotations or data, belongs to others and is used with permission or as allowed by law. These terms do not grant rights in third-party material, and Plutura does not claim ownership of it.
11Copyright notices
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). We may remove or disable access to reported material, notify the person who posted it and, in appropriate circumstances, end the accounts of people who repeatedly infringe. If your material was removed by mistake or misidentification, you may send a counter-notification that meets 17 U.S.C. § 512(g); we will explain how when we tell you about the removal. Anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f).
Send copyright notices to [email protected] or to Plutura Media (a trade name of HIMMELYS LLC), Attention: Copyright Notices, 111 N Wabash Ave, Ste 100 #3312, Chicago, IL 60602, United States. A notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner
- Identification of the copyrighted work you believe was infringed
- Identification of the material you believe is infringing and where it is on Plutura, such as its web address
- Your name, postal address, telephone number and email address
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner
12Automated access and data extraction
You may not use bots, scrapers or other automated means in a way that overloads or disrupts Plutura, gets around access controls or usage limits, or copies Plutura content at scale to republish it or to build a competing publication, database or service.
Search engines and AI crawlers that identify themselves and follow our published crawler instructions may access Plutura. Licensing and automated-access requests can be sent through Contact.
13Third-party links and services
Plutura links to other websites and may let you sign in with third-party services such as Google. We are not responsible for the content, policies or practices of sites and services we do not control, including advertisers; your use of them is governed by their own terms.
14Disclaimers
Plutura and its content are provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that Plutura will be uninterrupted or free of errors.
This applies to Plutura AI, our emails, comments and digital resources as well. To the extent permitted by law, we also disclaim warranties of title and quiet enjoyment, and we do not warrant that Plutura, its content or its downloads will be secure, complete, current or free of viruses or other harmful components. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.
These disclaimers are also made for the benefit of the authors, editors, reviewers and other contributors described in “Authors and contributors” and of HIMMELYS LLC’s owners and employees, and each of them may rely on them.
15Limitation of liability
To the extent permitted by law, Plutura, HIMMELYS LLC and their owners, employees and contributors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Plutura. Our total liability for all claims relating to Plutura, combined, is limited to the greater of the amount you paid for Plutura Plus, including payments collected by Polar, in the 12 months before the claim or US$50. Some jurisdictions do not allow these limits, so they may not apply to you.
These limits apply whatever the legal theory, including contract, warranty, negligence or other tort, and statute, to your use of or inability to use Plutura, Plutura AI, our emails, comments and digital resources, even if we were told that such damages were possible. They do not limit liability for fraud, for willful or wanton misconduct, or any other liability or consumer right that cannot lawfully be limited or excluded.
The amount above is one combined limit for Plutura, HIMMELYS LLC and all of the people described in “Authors and contributors” together, not a separate limit for each of them. To the extent permitted by law, those people have no personal liability to you, as explained in that section.
16Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless HIMMELYS LLC (Plutura Media) and its owners, employees, contributors (as described in “Authors and contributors”) and service providers against claims by third parties, and the resulting losses, liabilities, damages, settlements and reasonable legal fees, to the extent they arise from content you submit, your misuse of Plutura or Plutura AI, or your violation of these terms, the law or another person’s rights. This does not apply to the extent a claim results from our own negligence, fraud or misconduct, and it never requires you to pay our costs for a claim you bring against us. We may take over the defense of a covered claim at our own expense, and you agree to cooperate with us. We will not settle a covered claim in a way that admits fault on your behalf or imposes an obligation on you without your consent.
17Authors and contributors
In these terms, “contributors” means the authors, editors, reviewers (including expert reviewers), illustrators, photographers, guest writers and other people who create or review content for Plutura, whether they are employees, freelancers or outside contributors. Their work on Plutura, including articles, The Plutura Letter, digital resources and any comments they post, reflects their views as of the date it was published, may become outdated and is general information, not advice for your situation. Do not rely on it as the basis for personal decisions without checking with a qualified professional who knows your circumstances. No contributor is your financial or investment adviser, fiduciary, lawyer, doctor, therapist, counselor or pastor, and reading or responding to their work does not create a professional or fiduciary relationship with any of them.
Contributors create and review content for HIMMELYS LLC, which publishes Plutura. To the extent permitted by law, contributors have no personal liability to you for that content or for your use of it, and any claim about Plutura content must be brought only against HIMMELYS LLC, not against a contributor or an owner or employee of HIMMELYS LLC personally.
To the extent permitted by law, you release HIMMELYS LLC, its owners and employees, and all contributors from any claim arising from your reliance on Plutura content, answers from Plutura AI or digital resources. This release includes claims based on ordinary negligence in creating, reviewing or publishing that material, subject to the exceptions at the end of this section.
Contributors and HIMMELYS LLC’s owners and employees are intended third-party beneficiaries of “Informational purposes only”, “Plutura AI”, “Disclaimers”, “Limitation of liability”, “Indemnity”, this section, “Arbitration and class action waiver” and “Time limit for claims”, and each of them may rely on and enforce those provisions directly. Except as these terms state, no one else is a third-party beneficiary of them.
Nothing in this section limits a person’s liability for their own fraud or willful or wanton misconduct, or any liability that the law does not allow to be limited, excluded or released.
18Suspension and termination
We may suspend or close an account that breaks these terms, harms other readers or puts Plutura at risk, and remove content that does. You can stop using Plutura and delete your account at any time in My Plutura; deleting it also ends any active Plutura Plus membership, as explained when you confirm the deletion.
Parts of these terms that by their nature should continue, such as content rights, disclaimers and limitation of liability, continue to apply after an account is closed.
Suspension or termination does not authorize further Plutura Plus renewals. If we close your account for a reason other than a breach of these terms or the law, we will arrange a prorated refund of any unused paid period through Polar. “Comments and other submissions”, “Digital resources”, “Indemnity”, “Authors and contributors”, “Arbitration and class action waiver”, “Time limit for claims” and “General terms” also continue to apply after an account is closed, together with any payment obligations already incurred.
19Arbitration and class action waiver
Please read this section carefully because it affects your legal rights. You and Plutura agree to resolve most disputes through binding individual arbitration instead of in court, and to give up class actions and jury trials, as explained below. You can opt out within 30 days. This section applies once you accept these terms, for example by creating an account or buying Plutura Plus.
A “Dispute” is any claim or controversy between you and Plutura (HIMMELYS LLC, doing business as Plutura Media) arising out of or relating to these terms, Plutura, Plutura AI, Plutura Plus, our emails, digital resources or your account, whether based on contract, statute, tort or any other legal theory, including claims that arose before you accepted these terms unless a lawsuit about them had already been filed. It also covers claims against our owners, employees and contributors acting for Plutura, including the contributors described in “Authors and contributors”, and each of them may enforce this section. It does not cover your disputes with Polar or other third parties under their own terms.
Before starting arbitration or a small claims case, the party with a Dispute must send the other an individual written Notice of Dispute with their name, contact details, the email address of their account (if any), a description of the Dispute and the relief requested. Send yours to [email protected] or the postal address in “Contact”; we will send ours to your account email or another address you give us. Both parties will try in good faith to resolve the Dispute for 60 days after the notice is received, and filing deadlines are paused during that time. Nothing in this section prevents you from reporting a concern to a government agency.
If the Dispute is not resolved, it will be decided by one arbitrator in binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect when the arbitration is filed. The rules and filing forms are available at www.adr.org. If this section conflicts with the AAA’s consumer due process protections, those protections apply. The arbitrator will issue a reasoned written decision, and any court with jurisdiction may enter judgment on the award.
Instead of arbitration, either party may bring an individual claim in small claims court if it qualifies and stays there. Either party may also go to court to stop infringement or misuse of intellectual property, or unauthorized access to computer systems, and to ask for temporary emergency relief to preserve the status quo while an arbitration is pending. This section does not require arbitration of a claim that the law does not allow to be subject to a pre-dispute arbitration agreement, such as a sexual assault or sexual harassment dispute that the person bringing it chooses to take to court under 9 U.S.C. § 402.
The arbitrator decides all questions about the interpretation, scope, applicability and enforceability of this section, except that a court decides whether an agreement to arbitrate was formed, which version of these terms applies, the enforceability of the class action waiver and any other question the law reserves to a court.
Filing, administration and arbitrator fees are governed by the AAA’s consumer fee schedule: your filing fee will not be more than the fee the AAA sets for consumers, and Plutura pays the fees the AAA assigns to the business. If the arbitrator finds that a claim or the relief requested is frivolous or brought for an improper purpose, as measured by Federal Rule of Civil Procedure 11(b), fees will be allocated as the AAA rules and the law allow. Hearings take place by video or telephone, or on written submissions, unless the arbitrator decides an in-person hearing is needed; any in-person hearing will be held in the county where you live unless we both agree otherwise. Each party pays its own attorneys’ fees and costs unless the law or the AAA rules allow the arbitrator to award them.
You and Plutura may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, to the fullest extent the law allows. The arbitrator may not combine more than one person’s claims or preside over any class, collective or representative proceeding, and may award relief, including declaratory or injunctive relief, only in favor of the individual party seeking it and only as needed for that party’s individual claim. You and Plutura each waive a jury trial for Disputes resolved in arbitration. These waivers also apply to claims against any owner, employee or contributor covered by this section.
If a court decides that the class action waiver or the limits on relief cannot be enforced for a particular claim or request for relief, such as a request for public injunctive relief, that claim or request will be severed and decided by a court only after the individual arbitration of every other claim is finished, and the court case will be paused until then. All other claims stay in arbitration. You and Plutura do not agree to class arbitration: if a class or representative proceeding is allowed, it will take place in court, not in arbitration.
If 25 or more similar demands for arbitration are filed against or by Plutura with the help of the same or coordinated lawyers or organizations, the AAA’s Mass Arbitration Supplementary Rules and its mass arbitration fee schedule apply. This does not allow class arbitration or make the result of another person’s case binding on you. Filing deadlines are paused for each claim while it waits to be administered under those rules.
You may opt out of this arbitration agreement by emailing [email protected], or writing to the postal address in “Contact”, within 30 days after you first accept this arbitration agreement, for example by creating an account. Include your name, the email address of your account (if any) and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these terms or your access to Plutura or Plutura Plus.
This section continues to apply after your account is closed or your membership ends. If the AAA declines or stops administering the arbitration for a reason covered by Rule R-10 of its Consumer Arbitration Rules, such as unpaid fees or an arbitration agreement that does not meet its consumer due process standards, either party may take the Dispute to an appropriate court. If the AAA cannot or will not administer the arbitration for any other reason, the parties will agree on another arbitration provider, or a court will appoint an arbitrator under the Federal Arbitration Act.
20Governing law
These terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally, and that is not subject to arbitration or brought in small claims court under “Arbitration and class action waiver”, will be heard in the state or federal courts located in Cook County, Illinois, and you and Plutura consent to the personal jurisdiction of those courts. Nothing in these terms limits rights you have under the laws of the place where you live that cannot be waived.
The Federal Arbitration Act governs “Arbitration and class action waiver”. To the extent the law allows, you and Plutura waive a jury trial in any court proceeding between us.
21Time limit for claims
To the extent the law allows, any claim arising out of or relating to these terms or Plutura must be filed in arbitration or in court within one year after it accrues, or it is permanently barred. This does not shorten any period that the law does not allow to be shortened, and the time during which these terms require informal dispute resolution before filing does not count toward the year.
22Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change is material, we will say so on the site or by email before it takes effect. If you keep using Plutura after a change takes effect, the updated terms apply.
A change to “Arbitration and class action waiver” does not apply to a Dispute that arose before the change took effect, or that you or we had already notified to the other; the version in effect when the Dispute arose continues to apply to it. If you have an account, we will tell you about a material change to that section by email, and you may reject it by emailing [email protected] within 30 days after it takes effect; if you do, the version you last accepted continues to apply to you. A timely opt-out of arbitration remains effective after an update unless you later expressly agree to arbitrate. If the law requires additional consent to a change, we will obtain it before applying that change to you.
23General terms
These terms, together with any additional terms we show you and you accept for a specific feature, are the entire agreement between you and Plutura about Plutura and replace any earlier agreements on the same subject. Our Privacy Policy explains how we handle personal information. Polar’s terms govern its checkout and payment services.
If any part of these terms cannot be enforced, the rest remains in effect and that part will be enforced to the maximum extent the law allows, except as stated in “Arbitration and class action waiver”. If we do not enforce a part of these terms, we have not waived our right to enforce it later.
You may not transfer your account or your rights under these terms without our written permission. We may transfer these terms, for example as part of a merger, acquisition, reorganization or sale of assets, without reducing rights the law gives you.
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, government action, cyberattacks, or failures of the internet, power or service providers. This does not affect our security duties or your right to a refund for paid benefits we cannot provide.
You agree to receive notices, agreements and other communications from us electronically, by email to your account address or on Plutura, and that they satisfy any requirement that they be in writing, except where the law requires another method. Please keep your email address up to date. Send notices to us at [email protected] or the postal address in “Contact”. These methods do not replace formal service of legal process where the law requires it.
Section headings help you find your way and do not limit what a section says, and “including” means “including without limitation”.
